  • No civil court shall hold any jurisdiction with respect to any matter that falls under the RERA or the Appellate Tribunal’s jurisdiction. As it stands, no court has the authority to grant injunctions with respect to any decision taken by the Tribunal or RERA
  • If the Appellate Tribunal’s orders are not followed, a penalty will have to be paid. This penalty can be imprisonment of 3 years or a fine of upto 10% of the project cost or both.
  • If the promoter does not function in accordance with RERA’s order , they are liable to pay a penalty. This penalty can be a fine of up to 5% of the total cost of project
  • In case has any problems regarding violation of rules buy an agent, promoter or a buyer , they can file a complaint with RERA
  • In case a complaint has been raised against an agent or a buyer, the RERA has the right to stop them from continuing the activity with which regards the complaint was raised
  • If any party finds the solution provided by the RERA not satisfactory, they can then submit an appeal before the Appellate Tribunal
  • If there is any loss incurred by the buyer due to the promoter due to other people laying claim to the property, then it is the promoter’s responsibility to reimburse the buyer. There is no standing law regarding the compensation amount

Advantage of RERA Delhi

RERA has a number of benefits for the agent, buyer as well as the promoter. Some of the advantage of this act are as follows:

  • Defining Carpet Area: Before the introduction of RERA, there was no defined method to calculate the price of the project. However, after the RERA came into effect, there is now an established formula to calculate the carpet area.   • Advance payment: According to the RERA, a builder is not allowed to take more than 10% of the property value in the name of advance or application fees. This eases the burden on the buyer as they do not have to pay a large amount initially

Before the introduction of RERA, developers had the freedom to reallocate funds gathered from one project to another. These funds can only be withdrawn after receiving certification from a Chartered accountant, an architect or an engineer
  • Rights of the buyer: This dictates that if their is any defect or fault in construction within 5 years of allotment, the builder is obligated to make repairs within a period of  30 days with 0 cost to the buyer
  • Interest paid for default: Before the introduction of RERA, in case of possession delay of property, the interest liable to be paid to the buyer was significantly lower than what the buyer had to pay if there was a default from their end. Now, in case of default, both parties have to incur the same interest rate
  • Buyer’s right if there are cases of false promises: In case of a discrepancy in regards of what was offered initially by the builder and what is being delivered, the buyer can claim a refund for the full amount of advance. In some cases, the builder might have to pay an interest on the amount
  • In case of fault in title: In case the buyer finds a fault in the title at the time of possession, the buyer is entitled to reimbursement from the promoter. There is no specified cap for this amount
  • Right to information: The buyer reserves the right to know all the information of the project at all times. This information includes but is not limited to information regarding the layout, completion status, execution, etc
  • Grievance redressal: If the buyer, agent, or promoter has any sort of complaints regarding the project, they can file a complaint with RERA. If the decision taken by the RERA is not satisfactory, a complaint can be filed with the Appellate Tribunal

Documents Required for Registration with Delhi Real Estate Regulatory Authority

This form can also be used if you want to file a complaint regarding any defect in structure or regarding a delay in the completion of the project.

RERA Appellate Tribunal

Any aggrieved party who is not satisfied with the solution as provided by the RERA authority or RERA Adjudicating Officer, can approach the Delhi state Tribunal by filing an appeal via Form L.

Complaint Process for RERA Delhi

In this section, we will take a look at the step-by-step process you have to follow to file a complaint with Delhi Real Estate Regulatory Authority:

Step 1: You need to go to the RERA web portal and click on the tab that says “File Complaint”. Here, you need to create your ID and password with the user type set as “Complainant”. 

Step 2: You need to fill in all the relevant information and click the “Create User”. This will trigger a confirmation email being sent to your email address. You need to click on the activation link sent to you in order to verify your account.

Step 3: You can now log into the web portal by using the credentials you have generated in the first step. This needs to be done only once, all future complaints can be filed using the same User ID and password. 

Step 4: You need to fill in all the information in the respective form.

Step 5: You are then required to pay the complaint registration fee online. This fee is generally Rs. 1000 per complaint. You can choose to make this payment using a debit card, credit card, or via net banking.

Step 6: You then need to upload all the relevant documents supporting your complaint. If you choose to involve a legal practitioner, a Vakalatnama in the current format needs to be uploaded along with the form. 

Step 7: You can now submit your application by clicking on the “Submit” button. Please note that it is important to write down the complaint reference number for future processes.

You can submit a complaint with the Real Estate Regulatory Authority Delhi using the Form M, Form N, or Form L depending on the nature of your complaint.
