Telangana State Real Estate Regulatory Authority (TS RERA) was established in 2017 under the Real Estate (Regulation and Development) Act, 2016, to protect the interests of homebuyers and promote transparency and accountability in the real estate sector in Telangana, India.

According to RERA Telangana rules, developers cannot promote a project until it’s registered with RERA. Promotion includes advertising, offering for sale, and inviting people to buy. Developers also have to share quarterly reports on the real estate project.

The RERA Telangana website provides different services for builders, citizens and real estate professionals. These services include registering projects, registering as an agent, uploading documents, making online payments, downloading forms, searching for projects, and filing complaints.

About the Telangana RERA Act

Though the act existed prior to it being notified to the state of Telangana, it was the government that did not enforce the act. The rules and regulations of Telangana RERA under the RERA act were notified on July 31st, 2017. It was only after the publication in Telangana Gazette on 4th August 2017, that the Telangana rules became operational for the regulation of the real estate sector. The main objective of Telangana RERA was to create a robust, transparent, and competitive real estate sector for the state while keeping intact the interest of builders, agents, and buyers for promoting real estate.

Every real estate project whether a start-up or under construction, built over an area of 500 square meters, with over 6 units, and approved after or on January 1st, 2017, need to follow the rules and regulations set up by Telangana RERA. The RERA Telangana Rules and Regulations

The regulations presented by RERA Telangana are termed under the Telangana State Real Estate Rules 2017. It was in September 2018, that the government of Telangana notified the builders that any project approved on or after January 1st, 2017 should necessarily be registered with RERA to skip the charges of penalty. As per the state government of Telangana, the builders need to deposit 70% of the investment in the bank accounts and use it for the development and construction of the project.

If the area of construction for any real estate project does not exceed one thousand square meters, ₹5 per square meter is charged as the registration fee. If the area of construction for any real estate project exceeds one thousand square meters, ₹10 per square meter is charged as the registration fee. In the case of commercial projects, ₹20 per square meter is the registration fee for projects under one thousand square meters and ₹25 per square meter for projects exceeding the area of construction over one thousand square meters.

If a real estate project is a mixed one, ₹10 per square meter is charged as the registration fee for construction area under one thousand square meters and ₹15 per square meter for construction area over one thousand square meters. The rules mentioned in the Telangana State Real Estate Rules 2017, are applicable on every project approved on or after January 1st, 2017, by the authorities mentioned below:

  • Municipal Corporations
  • Urban Development Authority (UDA)
  • Telangana State Industrial Infrastructure Corporation (TSIIC)
  • Director of Town and Country Planning (DTCP)

  • Pay the registration fees to complete the process of registering a project with TS RERA

2nd November- Builders are pushing for changes in policies to enhance transparency-

Builders in Telangana are suggesting changes to the Real Estate (Regulation and Development) Act, 2016, aiming to make the real estate industry more transparent. They’re proposing adjustments to the TS RERA Portal to speed up project registrations and related processes. The builders are advocating for a title guarantee program and comprehensive title insurance, along with a reduction in the penalty for unregistered projects from 10% to 5%. These proposals aim to protect both builders and buyers in case of issues during a project. Additionally, builders want the TS RERA portal to have a user-friendly dashboard with project and builder lists for informed consumer decisions.

16th November- Telangana RERA takes strict action against rule violations-

Telangana RERA took action on November 15, 2023, by sending notices to several builders for not following RERA Act rules, like selling plots and apartments without proper registration. The companies were promoting projects without registering with Telangana RERA, which is required by law. This goes against the rules, and not complying gives buyers limited access to important information on the Telangana RERA website. These companies had 15 days to respond to the notice.
