  • The HIRA Act specifies that all real estate projects with more than eight apartments or 500 meters have to be registered under the Regulatory Authority.
  • The promoter has to file an application to HIRA in case of ongoing projects which do not comply with the issuance of the completion certificate. 
  • It is compulsory for a real estate project to be registered under the Housing Industry Regulatory Authority as per section 3 of the West Bengal Housing Industry Act. 
  • There has to be the implementation of transparent regulation across all the real estate projects. 
  • There will be a grievance system in which the buyers can show their discontentment. 
  • Real estate developers will not be able to chunk illegal transactions from a project to another.

Difference Between RERA and HIRA

How distinct is RERA from HIRA West Bengal?

While the main idea behind the well-geared development and operation of the real estate sector is the same in both cases, there are certain pennants that make West Bengal HIRA different from RERA. 

Here are the notable differences between both-

  • The Conditions of Planning Area

A planning area, as per the RERA Act, is a development area or a regional or local planning area or any area specified by the Government or any authority. RERA maintains the window for the projects that count under the planning areas. These areas are not restricted to the municipal realm and encompass larger swaddles of an area along with city extensions. 

The HIRA Act, on the other hand, does not maintain any such condition of checking up on only planning areas. 

  • Events

The RERA Act only deploys to fire, flood, drought, war, earthquake, cyclone, or any type of natural catastrophe that obstructs the spread of the projects, whereas the HIRA Act brings in the eventuality by adding any other stance as entailed. 

  • Garage Area 

For what the act of RERA maintains, a garage is a place in a project with walls and a roof on three sides which is used to park any vehicle. It does not cover the areas unmatching this description as in the open or uncovered parking areas. 

HIRA Act does not mention any such definition to the garage area. 

  • Compounding of Offences

In case of violation of the RERA Act, the defaulter can be punished under the Code of Criminal Procedure, 1973. 

Standing distinctive, the HIRA Act does not propose any provision in regard to the compounding of offences. 

HIRA West Bengal Registration- How to Register for Real Estate Projects

Here is how you can register for a real estate project under HIRA West Bengal-

Step 1: Head to the official West Bengal Housing Industry Regulatory Authority website. 

Step 2: Log into it and then click the “Online Registration” tab. 

Step 3: Now, hit the option for online registration. 

Step 4: Then you will find three options for online registration- Real Estate Agent, Real Estate Project and Complaint. Select the “Real Estate Project” one. 

Step 5: You will be landed on a page where you have to enter the user ID and password. 

Step 6: Click the “Continue” button in order to register. 

Step 7: In case you don’t have any user ID, you will have to sign up for a new account. 

HIRA West Bengal Registration- How to Register for Real Estate Agents

Step 1: Navigate to the official West Bengal Housing Industry Regulatory Authority website.

Step 2: Tap on the “Online Registration” option. 

Step 3: Click the “Real Estate Agent” option among the three options displayed on the screen. 

Step 4: You will now be sent to a page where you will have to input the user ID along with a password. 

Step 5: Now hit “Continue” in order to register.

You will be required to sign up for a new account in case you don’t have any user ID. 

Documents Required for HIRA West Bengal

Here are the documents for West Bengal HIRA that have to be submitted by real estate agents-

  • Copy of PAN card 
  • Details related to the enterprise including name, type of enterprise, and registered address
  • A photo of the concerned agent

How to File a Complaint to HIRA West Bengal

Step 1: Visit the official West Bengal Housing Industry Regulatory Authority website.

Step 2: Click the “Online Registration Tab”. 

Step 3: Click the “Complaint” option among the three options displayed on the screen. 

Step 4: You will be landed on a page in which you have to input the user ID with a password. 

Step 5: Now hit “Continue” in order to file a complaint.

You will be required to sign up for a new account in case you don’t have any user ID.
