UP RERA (Uttar Pradesh) was established under the Real Estate Regulation and Development Act passed by the Central Government in the year 2016. This strives to safeguard the purchases of homes by customers while boosting investments in real estate at the same time. The Act was enforced on the 1st of May, 2016.

UP RERA- Key Features

  • The State Real Estate Regulatory Authority has been established as the major government body holding responsibility for grievance redressal of consumers against any real estate developer.
  • Authority has been given to the real estate regulator for governing transactions in both residential and commercial real estate segments.
  • Real estate developers have to mandatorily post all details related to project plan, government approvals, layout, status of land title, sub-contractors for projects, completion schedule and others with RERA UP.
  • Maximum jail terms for violation of appellate tribunal of RERA orders will be 3 years with/without fines.
  • For project delays, developers are liable to pay interest similar to EMIs paid by consumers to the bank.
  • Developers cannot change plans sold without written consent obtained of the buyer.
  • Projects exceeding 500 square meters or more than 8 apartment units will have to be compulsorily registered with RERA UP.

Charges payable

  • Individual Agents have to pay Rs. 25,000 for registration
  • Agents other than individual will have to pay Rs. 2,50,000 as registration fees.
  • Promoters have to pay Rs. 10 per square meter for residential projects up to 1,000 square meters. The charges are Rs. 20 per square meter for commercial projects.
  • Appeals subsection (1) under the RERA UP Section 44 will be chargeable at Rs. 1,000 and the same amount has been laid down as the complaint charges.
  • Rs. 50,000 or a maximum of 10% of fees for registration (whichever is more) is payable for withdrawing registration applications.

Project Registration under UP RERA

Registering projects with RERA UP necessitates following these steps:

  • Visit the official website of UP RERA.
  • Choose the user type, i.e. agent or promoter. Enter the email ID/user ID and your password in addition to the captcha code.
  • Click Login for being taken to the webpage for registration of projects.
  • Fill up all necessary details and upload the documents required for projects that are being registered.
  • Finish the process of registration by paying the applicable charges and clicking on Confirm.

Documents needed for registration

Documents to be provided by promoters:

  • Copy of PAN card
  • Balance sheet for the last financial year
  • Income Tax Returns for last 3 financial years
  • Total parking area count (open) for the project
  • Encumbrance Certificate of property/land on which the project has been proposed
  • Title deed that indicates the promoter’s title on the land/property on which the project has been proposed
  • Collaboration agreement copy, joint agreement or supporting document if the promoter is not the property/land owner
  • Written application in the format given under subsection (1) of Section 4 based on Form A

Documents to be provided by agent:

  • Copy of PAN card
  • Details of enterprise for real estate agent, i.e. registered address, name, type of enterprise (societies, proprietorship, company, partnership, etc.)
  • Particulars of registration inclusive of bye-laws
  • Memorandum of Association
  • Articles of Association
  • Income Tax Returns for last 3 financial years
  • Address proof of the enterprise/business entity
